What exactly is a bare trust deed, and why does my SMSF need one?
It's the legal document that establishes a separate trust to hold legal title to an asset your SMSF borrows to acquire. Under SIS Act Section 67A, when an SMSF borrows to purchase an asset, that asset must sit in a separate bare trust so the lender's recourse is limited to that single asset. Without a properly drafted deed, your SMSF cannot lawfully borrow to buy property.
How fast will I actually receive my documents?

Will my bank's lawyers accept your deed?

Can the same person be both the SMSF trustee and the bare trustee?
No. The bare trustee must be a separate legal entity. If the same individual or company acted as both, the borrowing arrangement would fail the s67A compliance test and your fund could face significant ATO penalties. Most lenders require a special-purpose company as bare trustee, and we can arrange that registration as part of your package.
What about stamp duty on the deed?
It varies by state: NSW charges $750, the NT charges $5, Victoria requires mandatory SRO lodgement for a $0 assessment, and QLD, WA, SA, TAS and the ACT are exempt. Either way, we handle all stamping and lodgement requirements for you in every Australian jurisdiction.
My accountant said they'd "sort the paperwork". Why use a specialist?

Bare trusts are all we've done since 2009, so the lender-specific clause requirements, execution order and stamping quirks in each state are second nature. It's cheaper to get it right once than to fix a rejected deed while penalty interest runs.
What happens to the bare trust once the loan is repaid?
Legal title transfers from the bare trustee to your SMSF and the bare trust dissolves. That transfer is generally exempt from stamp duty in most states because it occurs pursuant to the terms of the bare trust deed. That's another reason the deed must be drafted correctly from the start.
I haven't signed a contract yet. Is it too early to talk?
